BULA FLIGHTS - Terms and Conditions for Flight Bookings
1. Definitions
For the purpose of these Terms and Conditions:
- BULA FLIGHTS ('we', 'us', 'our'): Refers to Lodhias Travel Services Pte Ltd IATA Accredited: 11300026, trading as BULA FLIGHTS.
- Customer ('you', 'your', 'the User'): Refers to any individual, small group, or family making a booking through BULA FLIGHTS for travel services.
- Platform: Means all or any of the relevant platforms, mobile applications, electronic interfaces, and websites that are owned, provided, and/or operated from time to time by BULA FLIGHTS, regardless of how it's accessed by users (including via the internet, mobile phone, or any other device or means).
- Terms ('these Terms', 'Terms and Conditions'): Refers to the entirety of this document, including any amendments or alterations published on the Platform from time to time
- Airline ('Operating Airline'): Refers to the air carrier providing the flight services.
- Supplier ('Service Provider'): Refers to any third-party entity providing travel-related services, including but not limited to airlines, transfer companies, accommodation providers, or tour operators.
- Booking: Refers to the arrangement made through BULA FLIGHTS for flights and any other travel services.
- Ticketed: Refers to the process by which an electronic airline ticket (eTicket) is issued and confirmed by the operating airline.
- Fare Rules: Refers to the specific conditions, restrictions, and policies set by the airline for a particular airfare, governing aspects such as changes, cancellations, refunds, and baggage allowances.This is beyond Lodhias Travel Services Pte Ltd.
- Force Majeure Event: Refers to any event or circumstance beyond BULA FLIGHTS' reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, acts of government, strikes, epidemics, pandemics, or technical failures.
- Intellectual Property Rights: Means all forms of intellectual property rights (whether registered or unregistered) in copyright, designs, patents, trademarks, domain names, trade secrets, know-how, confidential information, and all other similar proprietary rights which currently exist and/or are recognized in the future.
2. General Booking Information
- Fares and Availability - No Booking Held: Please note that all fares quoted are based on current seat availability and the most affordable rates available at the time of inquiry or generation. The BULA FLIGHTS system won't secure a seat without the passenger's full and accurate name. When a passenger's name is provided, there's no guarantee that a seat on the desired flight will still be available, nor is there a guarantee that the same fare level previously quoted will still be available.All fares are subject to change.
- Fare and Tax Changes: All fares and taxes are subject to change until the booking is paid in full and the ticket is issued. Fares and taxes may change without prior notice.
- Contact Information: Passengers are requested to provide local and destination mobile contact numbers for inclusion in their booking record. This enables the airline to contact passengers directly in case of flight delays, cancellations, or other operational changes.
- Duplicate Bookings: Airlines explicitly prohibit and don't tolerate duplicate bookings made for the same passenger by different agents or channels. All duplicate bookings detected by airlines will be automatically cancelled without prior notice. BULA FLIGHTS isn't responsible for any losses incurred due to such cancellations.
3. BULA FLIGHTS Role and Liability
- Agent Role: Travel arrangements and prices detailed on our websites are provided and coordinated by Lodhias Travel Services Pte Ltd IATA Accredited: 11300026, trading as BULA FLIGHTS. Sales of services, such as flights, as contained in our publications, are made by BULA FLIGHTS solely as an agent for the person, business, or company providing those services (e.g., the airline). The standards of these services are based on various factors generally accepted as indicative of a certain class or quality level.
- Information Accuracy: BULA FLIGHTS has exercised due care and responsibility in verifying and checking all information on our websites at the time of compilation. However, as this information is primarily supplied by the relevant airlines and other travel service providers, BULA FLIGHTS accepts no responsibility for any inaccuracy or misdescription contained within these publications.
- Price and Service Changes: BULA FLIGHTS doesn't accept responsibility for any changes in prices or variations of services as displayed. All services and prices are subject to change without prior notice.
- Limitation of Liability - Force Majeure & Beyond Control: BULA FLIGHTS doesn't accept liability, whether in contract or in tort (actionable wrong), for any injury, damage, loss, delay, additional expenses, or inconvenience caused directly or indirectly by:
- Force Majeure Events: Including, but not limited to, war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or any other authorities.
- Events Beyond Our Control: Accidents to or failure of machinery or equipment, or industrial action, or any other events that are beyond Lodhias Travel Services Pte Ltd reasonable control and aren't preventable by reasonable diligence on our part.
- Checking for Changes: It's essential that the passenger checks with us, or their travel agent, for any changes or variations to the information displayed on our websites. This will allow BULA FLIGHTS to advise the User, or their agent, of any such changes that we are aware of either before the User books their flights, or prior to their departure.
4. Acceptance of Terms and Amendments
- Acceptance of Terms: By booking with BULA FLIGHTS, the User confirms that they've read, understood, and agree to be bound by these Terms as altered or replaced from time to time.
- Amendments to the Terms: BULA FLIGHTS reserves the right to change, vary, or modify all or part of these Terms at any time at our sole discretion. In such cases:
- We'll post the updated Terms on the Platform; and
- The revised provisions will take effect prospectively from the time of their posting on our website.
- The User's Responsibility for Review: It's the User's responsibility to check these Terms periodically for changes. If the User objects to any variation to these Terms, their sole remedy is to immediately discontinue their use of the Platform
5. Quotes, Fares, and Price Variations
Our quotation system accesses both live and static pricing, depending on the airline or supplier. It's common for airlines and other suppliers to sell out, alter, or withdraw prices, including advertised special rates. If fares, rates, or inclusions vary from the User's quotation or from an advertised price, we'll advise the User of any change prior to processing their booking request and transaction. If the User doesn't wish to proceed with the booking at the new price, they may cancel the booking which may or may not incur a cost. Once the User's booking has been confirmed and payment received, any newly released specials can't be applied to existing bookings. Prior to full payment being received, BULA FLIGHTS reserves the right to vary prices and rates in the event of changes in exchange rates or price rises made by airlines or other suppliers. Should the cost of any service increase due to exchange rate fluctuations, price increases, tax changes, or any other reason, the User will be required to pay the increase upon notification by us, or they may cancel the affected booking. BULA FLIGHTS isn't liable in any way if any such increase occurs due to exchange rate fluctuations, taxes, or supplier notifications. Fares quoted are appropriate to the particular flight product at the time of quoting, and these fares may change prior to the travel date. All prices are subject to availability and can be withdrawn or varied without prior notice. This is beyond Lodhias Travel Services Pte Ltd. BULA FLIGHTS has the right to change fare price for our own promotions and special without any notification or alerts.
6. Passenger Details and Name Changes
- Name Accuracy: The passenger's name provided in a booking must precisely match the name as it appears on their valid passport or other government-issued identification used for travel.
- Name Correction Before Ticketing: The name correction May or May NOT be possible for a booking prior to ticket issuance is subject to the policies of the respective airline. Certain airlines may permit name corrections within the same booking reference without requiring the cancellation of the existing reservation. Conversely, other airlines may prohibit modifications within the same booking reference, thereby necessitating the cancellation of the original booking and the creation of a new reservation. In instances where re-booking is required, BULA FLIGHTS does not guarantee the availability of seats in the same fare class or on the same flight. To ensure the accuracy of passenger information and minimize the risk of booking discrepancies, BULA FLIGHTS may request a copy of the passenger’s passport or other valid identification prior to or during the booking process. It is the responsibility of the passenger to verify that all personal details, particularly the name, DOB and Passport Number exactly match the details on the passport or identification document submitted.
- 6.3 Name Correction After Ticketing: Following the issuance of a ticket, the applicable fare rules shall be reviewed to determine whether the respective airline permits a name correction. It is expressly acknowledged that most airlines prohibit full name changes once a ticket has been issued; only limited name corrections—typically to rectify minor spelling errors—may be permitted, subject to the individual airline’s policies. Any permitted name correction is subject to applicable change fees and service charges, as imposed by the airline, in accordance with the fare rules governing the issued ticket. These charges are the responsibility of the passenger and may vary by airline and fare type.
- Domestic Travel Identification: All adult passengers traveling on domestic flights are required to present valid identification at the airport during check-in. This ID will be used to verify the passenger's identity against the booking record as part of the check-in and boarding process. Therefore, the passenger's name in the booking must precisely match their identification (e.g., Passport, National ID, Driver's License) for acceptance on domestic flights.
7. Payment Terms
- Issuance of Documents: Travel vouchers, electronic airline tickets, and booking confirmations will only be issued once full payment at the time of booking has been received and cleared.
- BULA FLIGHTS, a division of Lodhia Travel Service, may offer a "Book Now, Pay Later" option; however, eligibility for this option is strictly subject to the fare rules as determined by the respective airline. Certain special or promotional fares may require immediate payment at the time of booking and are not eligible for deferred payment.
- Year-round fares, a limited payment window—typically up to 48 hours—may be available, but this is not guaranteed and remains subject to airline policy and fare conditions. BULA FLIGHTS does not warrant the availability of fare holds or deferred payment on any specific fare. Clients are strongly advised to contact our reservations team directly to confirm payment timelines and applicable conditions. Failure to do so may result in forfeiture of quoted fares or seat availability, for which Lodhia Travel Service shall not be held liable. It is the responsibility of the customer to seek clarification on any aspect of this policy that is not fully understood, to avoid disappointment or the loss of special fare opportunities.
- Credit Card Surcharges: A surcharge of 4% will apply to all credit card transactions processed via the EFTPOS terminal, including but not limited to American Express, international credit cards, Visa, and MasterCard. This surcharge is levied by the payment processing provider and is beyond the control of Lodhias Travel Services Pte Ltd.
- Please note that fees may or may not apply to payments made via Electronic Funds Transfer (EFT) such as M-paisa or MyCash or Direct Deposit, depending on Merchant. It is the responsibility of the customer to ensure that funds are transferred promptly and received in Lodhia Travel Services Ltd’s account by the due date in order for tickets to be issued. Any delay in payment may result in the cancellation of the booking or reservation, for which Lodhia Travel Services Ltd accepts no liability.
- Payment Processing Terms: By providing their credit card details and accepting these Terms, the User authorizes BULA FLIGHTS to arrange for funds to be debited from their nominated credit card for the purposes of their booking.
- Currency Conversion Fees: The User's bank or credit card provider may apply additional currency conversion fees or charges. BULA FLIGHTS isn't responsible for these fees.
- Value added Tax (VAT): In some cases, the provision of transactions arising from the User's bookings may or may not be subject to Tax
- Where Tax is applicable, our advertised prices are inclusiveof VAT.
- Where VAT isn't applicable, our advertised prices are exclusive of VAT In the event that BULA FLIGHTS' services are subsequently determined to be a taxable supply, the User must pay BULA FLIGHTS all applicable Tax in addition to any other amounts payable by the User to BULA FLIGHTS in respect of that taxable supply. This will be payable by the User when they are required to pay for the services. BULA FLIGHTS will issue a tax invoice for any taxable supply to the User, which will enable the User, if permitted by the Tax Law, to claim a credit for tax paid.
8. Flight Changes, Cancellations, and Refunds
- Flight Changes: Flight changes may or may not be permitted, typically at least 24 hours prior to the scheduled departure time, subject to the specific fare rules of the User's ticket. Any change requiring ticket re-issuance must be completed within 72 hours of the new booking being made.
- If the original class of travel is available, only a re-issuance fee will apply.
- If the same class isn't available, the fare may need to be upgraded to a higher fare level, subject to availability, requiring payment of the fare difference in addition to a re-issuance fee and tax difference if any.
- Cancellation and Refund Policies (Fare Types): Refund eligibility and applicable penalties are strictly governed by the fare rules associated with the User's purchased ticket.
- Restricted Fares: Generally non-refundable.
- Semi-Flexible Fares: Mostly non-refundable. If a refund is permitted, a penalty will apply. The airline will assess the fare for the journey already travelled, and any remaining balance, if any, will be refunded less the applicable refund penalty.
- Fully Flexible Fares: Refunds may be subject to a penalty. The applicable airline will assess the fare conditions for the journey. If the fare is deemed refundable, the refund amount will be processed less any applicable administration fees.
- No-Shows: Failure to check in and board their flight at the airport, or failure to cancel their confirmed and ticketed booking at least 24 hours prior to the scheduled travel date, will result in the immediate forfeiture of the ticket's value. No refund will be made by the airline or BULA FLIGHTS in such cases. For any refund or cancellation, it's the passenger's or sponsor's responsibility to notify BULA FLIGHTS to cancel the ticketed booking at least 24 hours prior to the scheduled departure date to avoid a 'no-show' designation. It's therefore crucial that any changes or cancellations to bookings are made strictly in accordance with the applicable fare rules and well in advance of their departure date (in most cases, a minimum of 24 hours before the scheduled flight departure).
- Standard Cancellation Policy Overview: Refunds for bookings are strictly dependent on the terms and conditions of the fare rules of the relevant airline or service supplier
- Cancellation Procedure: All cancellation requests must be submitted in writing or via email and addressed directly to the BULA FLIGHTS consultant handling the User's booking. The User may also send requests to bula@bulaflights.com
- Flight Cancellation Policy Specifics: Flights booked through BULA FLIGHTS are exclusively governed by the specific fare rules and terms and conditions of the airfare the User purchased, as determined by the operating airline (not BULA FLIGHTS). These terms and conditions vary significantly from airline to airline.
- In most cases, airfares are fully non-refundable and non-transferable; however, this is always subject to the individual airline's terms and conditions.
- Airline-specific charges, or partial or full cancellation fees, may apply to the User's particular airfare.
- A BULA FLIGHTS Travel Consultant will provide assistance wherever possible within the confines of these Terms and the applicable airline rules.
9. Fees and Charges
- Amendment Fees: Certain amendments made to confirmed bookings may incur a BULA FLIGHTS administration fee, depending on the nature and value of the booking. These fees are charged per amendment and are in addition to any change fees that may be levied by the airline.
- Credit Card Chargeback Fees: Any fees incurred by BULA FLIGHTS from our credit card payment provider arising from a chargeback or a disputed charge initiated by the cardholder will be charged back to the cardholder. This fee is non-refundable.
10. During Travel and Post-Booking
- Changes to Itinerary After Travel Has Commenced: Any alteration or cancellation of services after the User's travel has commenced may incur penalties. Please note that there will be no refund for unused services (e.g., flight segments or ancillary services).
- Voluntary Changes to Flights During Travel: BULA FLIGHTS won't be liable for any refunds or credit should the User decide to make voluntary changes to their non-refundable flight(s) once their travel has commenced. If the User genuinely needs to change their flight(s) while traveling, please contact their BULA FLIGHTS consultant as soon as possible.
- Airline Services: BULA FLIGHTS shall not be held liable for any refunds arising from unsatisfactory service provided by the airline or changes made by guests either before or after check-in. Guests who wish to lodge a complaint must submit a formal written request along with all relevant supporting documentation (e.g., photographs, videos, email correspondence) to Lodhia Travel Services Ltd. The matter will be reviewed by our escalation team in coordination with the respective airline, and each complaint will be assessed on a case-by-case basis. Guests will be kept informed of the progress and outcome of the investigation. Lodhia Travel Services Ltd accepts no responsibility for any disruptions, inconveniences, or adverse outcomes beyond its control.
- Refunds Procedure: All refund requests must be submitted in writing or via email directly to BULA FLIGHTS.
- Refunds won't be made by BULA FLIGHTS for bookings canceledcancelled due to inclement weather or illness. Such claims must be pursued through the User's travel insurance provider.
- No refunds will be made for services once travel arrangements have commenced.
- BULA FLIGHTS provides no guarantee or warranty that any refund will be available, as refunds are subject to the fare rules
- Reporting of Incidents: Any abnormal incidents, including injuries, significant service problems, cancellation of a service, or overall dissatisfaction, must be reported to BULA FLIGHTS immediately during the event. This allows BULA FLIGHTS the opportunity to attempt to rectify the situation or provide assistance while the User is still traveling.
- Seat Assignments and Other Airline Services: Once the User's flights are confirmed, they should contact the operating airline directly to request services such as seat assignments, special meals, or additional baggage allowances. It's the User's responsibility to ensure the airline has their most current contact information. Should the User's phone contact details change, they must notify the airline directly (and BULA FLIGHTS, for record-keeping purposes). Please note that BULA FLIGHTS is also able to assist with specific requests for seat assignments, special meals, baggage allowances, or other ancillary airline services which will incur a cost.
- Airline Tickets and Check-in: In most cases, the User's airline tickets will be issued as an electronic ticket (eTicket). Upon receipt of their travel documents from BULA FLIGHTS, the User must open and carefully review all attachments. Please ensure the User checks in for their flight in strict accordance with the requirements of the particular airline.
11. User Travel Responsibilities
- Travel Requirements and Documentation: The User is solely responsible for ensuring that they hold all necessary and valid passports (must have more than 6 months validity), visas, health certificates, and other required travel documents for all countries they intend to visit, enter, or transit through. This includes complying with any specific entry, exit, health, customs, or other regulations of any destination or transit country. BULA FLIGHTS accepts no liability for any loss, damage, or expense incurred due to the User's failure to comply with these requirements, including denial of boarding or entry, fines, or repatriation costs. The User is advised to consult with relevant government authorities and embassies/onsulates well in advance of travel.
- Baggage Policy: Baggage allowances (including checked and carry-on baggage) and any associated fees are determined solely by the operating airline and the specific fare purchased. These policies vary significantly between airlines and may change. The User is responsible for understanding and adhering to the baggage policies of their specific airline(s). Any excess baggage fees or charges for specialized items (e.g., sporting equipment) are the User's sole responsibility and must be paid directly to the airline. BULA FLIGHTS is not responsible for lost, damaged, or delayed baggage.
- Check-in and Boarding Deadlines: The User is solely responsible for adhering to the airline's published check-in deadlines and boarding gate closure times. These deadlines vary by airline and airport and can be found on the airline's website or booking confirmation. Failure to comply with these deadlines may result in denial of boarding, forfeiture of the ticket, and no entitlement to a refund from either the airline or BULA FLIGHTS. BULA FLIGHTS strongly advises the User to arrive at the airport well in advance of their scheduled departure time.
- Unaccompanied Minors and Child Travel: BULA FLIGHTS' booking services are primarily for adults or families traveling together. The booking of unaccompanied minors (children traveling without an adult guardian) or children traveling with an adult who isn't their legal guardian is subject to strict airline-specific policies, age restrictions, and may require special documentation or additional fees. The User is solely responsible for understanding and complying with the operating airline's specific policies for child travel and unaccompanied minors. BULA FLIGHTS takes no responsibility for issues arising from the User's failure to adhere to these airline policies.
12. Specific Travel Product Information
- All airfares are quoted based on real-time availability at the time of inquiry and are subject to change until ticketed. In the event that a customer has booked accommodation and the accommodation is subsequently cancelled for any reason, BULA FLIGHTS shall not be held liable for any refunds, losses, or associated costs arising from such cancellation. It is the customer’s sole responsibility to contact BULA FLIGHTS to request the reissuance of any affected flight tickets. Reissuance is subject to airline policies and applicable service fees, which will be borne by the customer.
- Group and Incentive Travel: Group and conference rates are specially contracted and unique to a particular group. As such, they are subject to different terms and conditions compared to standard individual flight bookings. If the User is booking for a group or incentive travel, it's their responsibility to ensure that these specific conditions are fully understood and explained to the User by their BULA FLIGHTS consultant.
- Children's Fares and Rates: Child fares for flights rates are generally based on the child's age at the time of travel and the specific fare rules of the airline.
- Travel Insurance: It is highly recommended that the User obtains comprehensive travel insurance immediately upon booking their flights arrangements. It is ESSENTIAL that this insurance provides coverage for involuntary cancellation of their trip, including their airfare(s), medical emergencies, baggage loss, and other unforeseen circumstances.
13. Website and Content Disclaimers
- Website Content and Visuals: All maps, photographs, illustrations, and computer-based graphics displayed on BULA FLIGHTS' websites and promotional materials are included for general illustrative purposes only and aren't always indicative of the exact subject matter. Specifically, airplane interiors, airport lounges, or accommodation photographs (if shown) may not be specific to the actual aircraft or room the User will occupy. Maps are not to scale and are for general orientation only.
- Quotations: All quotations for flights and other services are subject to the availability of the services quoted and aren't guaranteed until the booking is confirmed full payment is received. Unless otherwise stated, quotes are valid for 48 hours from their issue date.
14. Legal Disclaimers
- General Limitation of Liability: To the fullest extent permitted by law, all express or implied representations, conditions, guarantees, warranties, and provisions (whether based on statute, common law, or otherwise) relating to these Terms are hereby excluded. For the avoidance of any doubt, this clause doesn't operate to exclude, restrict, or modify any statutory rights, guarantees, or warranties that can't lawfully be excluded, restricted, or modified.
- Total Liability: BULA FLIGHTS' total liability for any breach of these Terms, or for any breach of our contractual obligations or duties at law or in equity (however arising), is strictly limited, at our sole option, to:
- The re-supply of the services; or
- The payment of the cost of having the services supplied again by BULA FLIGHTS.
- Indemnity: The User agrees to indemnify and hold BULA FLIGHTS harmless from all damages, costs, and expenses (including reasonable legal costs) that BULA FLIGHTS may suffer or incur as a result of the User's breach or alleged breach of these Terms.
- Severability: Each clause in these Terms is severable. If any clause is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining clauses will remain in full force and effect.
15. Financial Inclusions and Exclusions
- Prices DO Include: Flights, government taxes, and any other specific inclusions as expressly detailed in writing on the relevant product pages for each airline or service provider's offering.
- Prices DO NOT Include: Any costs incurred en route to and from the alcoholic beverages on board, telephone calls, items of a personal nature, passport and visa fees, travel insurance, excess baggage charges, or any other services not explicitly specified as being included on the relevant product pages for each airline or supplier's offering.
16. Website Copyright and Intellectual Property
Copyright on all elements of BULA FLIGHTS' website (the "Platform") is held by Lodhias Travel Services Pte Ltd IATA Accredited: 11300026. This includes, but is not limited to, all HTML, original/custom artwork, maps, navigation elements, presentation methods, design elements, descriptive text, and photographic images.
- All BULA FLIGHTS' Intellectual Property Rights in and relating to the production, development, and supply of the goods or services (excluding any material licensed to BULA FLIGHTS) remain BULA FLIGHTS' property and shall not be transferred, assigned, licensed, reproduced, disclosed, or otherwise given to any other person by the User.
- The User must keep confidential and shall not use any of BULA FLIGHTS' confidential information without our prior written consent.
- Certain photographic images on the Platform may be reproduced only with the prior written permission of BULA FLIGHTS and the product and/or service providers represented on the website, or as necessary to satisfy the copyright obligations associated with their electronic reproduction.
- Where joint copyright is held over proprietary text or images, BULA FLIGHTS reserves the right to pursue all copyright infringements on behalf of the primary copyright holder.
- Where the copyright for a photographic image is held exclusively by a third party under license, >BULA FLIGHTS reserves the right to vigorously protect the copyright of those images on behalf of the third party.
- All HTML files used in BULA FLIGHTS' websites are declared to be proprietary software products developed for use by BULA FLIGHTS only, and as such are subject to international intellectual property conventions.
- All custom graphics used are declared to be works of art created for use by BULA FLIGHTS only, and as such are subject to international intellectual property conventions.
- Image files, HTML documents, and text files from the Platform are not to be relocated to another server or duplicated for commercial purposes without the express written permission of BULA FLIGHTS. Please contact us if the User has any further queries about our security, privacy, or data handling procedures.
17. Complaint Process
Where possible, BULA FLIGHTS will endeavour to resolve the User's complaint at the first point of contact. If we are unable to resolve the User's complaint immediately, BULA FLIGHTS will undertake a thorough investigation of the User's complaint and provide the User with our findings. If the User is satisfied with BULA FLIGHTS' proposed decision or actions, we will formally close the User's complaint and record the findings for our continuous improvement program.
18. Platform Usage
- General Use: These Terms govern the User's use of and access to the Platform. By using the Platform, the User agrees to these Terms. If the User doesn't agree to the Terms, they may not use the Platform. It is the User's responsibility to check these Terms periodically for changes. If the User objects to any variation to these Terms, their sole remedy is to immediately discontinue their use of the Platform. By using the Platform, the User affirms that they:
- Are 18 years of age or older; or
- Otherwise possess legal parental or guardian consent and have obtained the consent of the payment method provider for their purchase of our services. As long as the User complies with these Terms, BULA FLIGHTS grants the User a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.
- Accessibility Statement: BULA FLIGHTS is committed to providing an accessible Platform for all users. 19. Privacy Policy
- Application: BULA FLIGHTS' Privacy Policy, which details how we collect, use, and protect the User's personal data, can be found on the Platform and applies to the User's use of the Platform and its services.
- Updates: The Privacy Policy may be updated from time to time and is effective immediately upon posting such changes on the Platform.
- Cookies Policy: The Platform uses cookies and similar tracking technologies to enhance user experience, analyze website usage, and for marketing purposes. For detailed information on how BULA FLIGHTS uses cookies and how the User can manage their preferences, please refer to our separate Cookies Policy, available on the Platform.
20. Access to the Platform
The User's access to the Platform may be suspended without notice in the case of system failure, maintenance or repair, or any reason beyond our control or simply because we wish to do so. Except as expressly provided otherwise in the Terms, BULA FLIGHTS reserves the right to change or discontinue any website, page, functionality, feature, or service on the Platform at any time. The Platform contains Content that is protected by BULA FLIGHTS' Intellectual Property Rights and those belonging to third parties. Except as expressly provided otherwise in the Terms, the User doesn't have any right, title, or interest in or right of use of any Content on the Platform.
21. Registration of Users
- User Registration Requirements: To access or use certain parts of the Platform, the User may be required to register as a user and open an account (including setting up an identification name and password) and agree to certain terms and conditions. When registering as a user of the Platform, the User must:
- Provide BULA FLIGHTS with accurate, complete, and up-to-date registration information, as requested;
- Provide BULA FLIGHTS with a form of identification to verify the User's identity, if requested; and
- Inform BULA FLIGHTS of any changes to the User's registration information.
- User Registration Restrictions: When registering as a user of the Platform, the User mustn't:
- Register as a user multiple times or more than once using one email address; or
- Impersonate or create a user registration for any person other than the User.
- Registered User Responsibilities: As a registered user of the Platform, the User must:
- Ensure the security and confidentiality of their user registration details, including any username and/or password that they select;
- Notify BULA FLIGHTS immediately if they become aware of any unauthorized use of their user details; and
- Not permit their user details to be used by or transferred to any other person. The User is entirely responsible for all activities which occur under their user details as a result of their failure to keep their information secure and confidential (including unauthorized use of their credit card or other payment details).
- Suspension or Termination of Access: BULA FLIGHTS reserves the right, in our sole discretion, to suspend or terminate the User's use or access to all or any part of the Platform, including if we believe the User is abusing the use of the Platform in any way; have breached these Terms; or are no longer an active user of the Platform. If BULA FLIGHTS suspends or terminates the User's use or access to all or any part of the Platform, we may, without limitation:
- Delete and/or remove or prevent further access to any or all of the User's material; and
- Refuse to allow the User future access to the Platform or use of our services.
22. Use of the Platform
- Location-Based Services: Some of the essential features of the Platform may require the use of 'location-based' services and technology. The User's use of the Platform is their acknowledgement that the location tracking features of their mobile device must be enabled at all times when they are using the Platform. BULA FLIGHTS expressly disclaims any liability for the failure of the Platform to perform as intended if such location tracking features have been disabled or fail to properly function on the User's mobile device.
- Prohibited Uses: The User mustn't, without BULA FLIGHTS' prior written consent:
- Use the Platform in breach of any applicable laws or regulations;
- Use the Platform (or Content obtained from the Platform) to:
- Transmit (or authorize the transmission of) "junk mail," "chain letters," unsolicited emails, instant messaging, "spimming," "spamming," or large amounts of untargeted, unwanted, or repetitive content, other than to share links to or content the User generates by and through the Platform on those of their authorized social media platforms for the purposes of beneficially sharing their use of the Platform and the services and promoting the Platform and the services;
- Impersonate any person or entity;
- Solicit money, passwords, or personal information from any person;
- Harm, abuse, harass, stalk, threaten, or otherwise offend others (other than accessing user location data made available to the User in the manner intended by the Platform); or
- For any unlawful purpose;
- Use the Platform to upload, post, transmit, or otherwise make available (or attempt to upload, post, transmit, or otherwise make available) any Material that, in BULA FLIGHTS' opinion:
- Isn't the User's original work or material in which the User has all relevant Intellectual Property Rights, or which in any way violates or infringes (or could reasonably be expected to violate or infringe) the Intellectual Property Rights or other rights of another person;
- Contains, promotes, or provides information about unlawful activities or conduct;
- Is, or could reasonably be expected to be, defamatory, obscene, offensive, threatening, abusive, vulgar, profane, or otherwise unlawful, including Material that racially or religiously vilifies, contains cruelty or abuse (including to animals), incites violence or hatred, or is likely to offend, insult, or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation, or any physical or mental disability;
- Exploits another person in any manner;
- Contains excessive violence or sexual acts;
- Includes an image or personal information of another person or persons unless the User has their consent;
- Poses or creates a privacy or security risk to any person;
- Confirm whether any Material the User uploads using the Platform conforms with these Terms.
- Material Uploaded by Users: BULA FLIGHTS isn't responsible for, and accepts no liability with respect to, any Material uploaded, posted, transmitted, or otherwise made available on the Platform by any person other than us. BULA FLIGHTS won't be taken to have uploaded, posted, transmitted, or otherwise made Material available on the Platform simply by facilitating others to post, transmit, or make Material available, nor do we endorse any opinion, advice, or statement made by any person other than us.
- Accuracy of Information Provided by User: The User is responsible for ensuring the accuracy and completeness of any Material or information they provide to BULA FLIGHTS via the Platform or otherwise in order for us to provide our services. BULA FLIGHTS isn't responsible or liable to the User for any loss or damage due to, without limitation, the User providing us with inaccurate or incomplete information regarding the requested services such as recipient identification or delivery information.
23. Third-Party Features
- External Links and Content: The Platform may feature or display links and pointers to websites, content, and advertising owned and/or operated by third parties (Third-Party Features). Third-Party Features (if any) don't form part of the Platform and aren't under our control. By featuring or displaying such Third-Party Features, we don't in any way represent that we recommend or endorse the relevant third party, its products, or services. BULA FLIGHTS doesn't accept any responsibility in connection with any Third-Party Features. If the User engages with any such Third-Party Features, the User does so entirely at their own risk.
- Payment Gateways: The payment gateways, if any, integrated into the purchase process made available through this Platform are maintained or developed by third-party service providers and aren't maintained or developed by us. The User's use of such services is subject to the terms and conditions of use maintained by such third parties, and BULA FLIGHTS isn't responsible to the User for their use of their payment gateway services. The User acknowledges that BULA FLIGHTS has no responsibility for and isn't liable in relation to any information provided to or via the payment gateway.
- Linking to the Platform: The User mustn't link to the Platform from any other website (or otherwise authorize any other person to link from a third-party website to the Platform) without our prior written consent.
- Offline Activities: From time to time, we may promote, advertise, or sponsor functions, events, offers, competitions, or other activities that may be conducted offline and may be conducted by third parties. The User participates in any such activities entirely at their own risk. BULA FLIGHTS doesn't accept any responsibility in connection with the User's participation in activities conducted by any third party. These communications and/or activities may be subject to separate terms and conditions and are conducted in accordance with the terms of the Privacy Policy.
24. Content Disclaimer
The User assumes total responsibility for their use of the Platform and any linked independent third-party websites. Except where expressly stated otherwise, content on the Platform is provided as general information only. It's not intended as advice and mustn't be relied upon as such. The User should make their own inquiries and take independent advice tailored to their specific circumstances prior to making any decisions. The User acknowledges and agrees that:
- Transmissions on the internet are never completely private or secure, and the User understands that any message or information they send to or download from the Platform (where permitted) may be read or intercepted by others.
- BULA FLIGHTS isn't responsible for, and accepts no liability in relation to, any other users’ use of, access to, or conduct in connection with the Platform in any circumstance.
- BULA FLIGHTS can't ensure that any images, files, or other data the User downloads, shares, or obtains from the Platform (if they are permitted to do so) will be free of viruses or contamination or destructive features.
- The Platform and its content are delivered on an "as-is" and "as-available" basis.
- While BULA FLIGHTS uses reasonable endeavors to ensure that the Platform is available continuously, we don't make any representations or warranties that the User's access will be uninterrupted, timely, secure, error-free, or that any defects will be corrected, or that the User's use of the Platform will provide specific results or benefits, and BULA FLIGHTS won't be liable for the same.
- The User's sole remedy against BULA FLIGHTS for dissatisfaction with the Platform or any content or material is to stop using the Platform.
- Alterations, modifications, or variations to the Platform or content that aren't performed by BULA FLIGHTS.
- Damage or failure caused by unusual or non-recommended use or application of the Platform or content.
- Updates to the iOS, Android, or other relevant mobile operating platform, the API environment for the relevant mobile operating platform, or any other release of a version of any relevant software which renders features of the Platform unstable or unusable.
- Loss caused by any factors beyond BULA FLIGHTS' control. The User is solely responsible for the safe use of the Platform and for their own personal safety at all times while using the Platform, and the User assumes responsibility for anyone they contact using the Platform. The User expressly acknowledges and agrees that their use of the Platform is at their own personal and sole risk. The User further acknowledges that the Platform isn't suitable for use in mission-critical applications or in hazardous environments requiring fail-safe controls. The User assumes full responsibility for any information transmitted via the Platform and for their personal safety at all times while using the Platform.
No warranty is given, and BULA FLIGHTS won't be liable for:
25. Airline Interline Agreement
This agreement permits interline carriage and baggage acceptance between participating airlines, subject to the availability and operational compatibility of interline ticketing arrangements. In the event that BULA FLIGHTS displays itineraries involving multiple airline combinations, and Airline A is unable to issue a ticket under its ticket stock for an itinerary that includes Airline B, Lodhias Travel Service Pty Ltd reserves the right, at its sole discretion, to issue separate tickets for the respective airlines involved. The issuance of separate tickets may result in fare discrepancies, and Lodhias Travel Service Pty Ltd makes no guarantee that the fares applicable at the time of initial booking will remain available or valid.
